Course Objective
The objective of this course is to analyze the first part of the general provisions of the Turkish Law of Obligations within the framework of jurisprudence and literature. The course focuses mainly on the law of contracts, not least formation of contracts, representation, validity, interpretation and content of contracts, law of tort and unjust enrichment.
Course Content
In this course, systematics of Code of Obligations, sources of debt and debtor-creditor relationships, liability, basis of debtor-creditor relationships, debts arising from legal transactions and in particular from contracts, standard terms and conditions, representation, characteristics and types of contracts, effects and consequences following contract formation, adaptation of contracts to the new conditions will be studied. In addition, obligations in tort and obligations deriving from unjust enrichment will be covered.
Course Learning Outcomes
- Student defines sources of obligations.
- Student defines the term of obligation.
- Student defines arising by obligations contract. And he/she comprehends provisions about contracts (conclusion of the contract, form of contract, terms of the contract, defect in consent, agency, etc.)
- Student defines obligations in tort.
- Student defines obligations deriving from Unjust Enrichment.
