Course Content

In Islamic Law, from its inception to the present day: the codification of fiqh and attempts at legal codification, and the concrete example of this in the Ottoman Empire: the Mecelle/General Principles

Course Learning Outcomes

  1. İslam Hukukunda başlangıçtan günümüze kadar kanunlaştırma teşebbüslerinin neler olduğunu tanıyabilme
  2. Hukuk bilimi açısından kanunlaştırmanın önemi ve gerekliliği hakkında fikir edinebilme
  3. İslam hukukunda kanunlaştırma faaliyetine temel teşkil edecek klasik literatürü tespit edebilme
  4. Muhteva ve teknik özellikleri itibariyle Mecelle ve diğer kanunnameleri karşılaştırabilme
  5. Dönemin hukuki ihtiyaçlarını karşılaması bakımından Mecelle’yi bütüncül bir biçimde analiz edebilme
  6. Mecelle kaideleri ile klasik dönemde oluşturulan külli kaideler arasındaki benzerlik ve farklılıkları tespit edebilme
  7. Hukukî emniyet ve istikrarın sağlanmasında Mecelle’nin rolünü kavrayabilme
  8. Mecelle’nin uygulandığı ülkeleri inceleyerek, hukuk-toplum bütünleşmesinin hangi oranda sağlanabildiğini ortaya koyabilme
  9. Mecelle’nin hazırlanmasında benimsenen yöntem ve teknikleri kavrayabilme
  10. Külli kaidelerin tarihi gelişimi ve literatürü hakkında bilgi sahibi olabilme
